Services provided by BPS through the website will be available to job seekers or other users. Access to and use of the contents and services provided on the website will be subject to the terms and conditions which are set out below and the privacy statement.
If you do not accept either or both of the Terms and Conditions and/or the Privacy Statement, please do not join, access, view, download or otherwise use any services offered by BPS via the website. By your continued use of the website, you acknowledge that you have read and understood the Terms and Conditions and the Privacy Statements and that you agree to be bound by all of its provisions. BPS reserves the right to amend, add to, delete or revise the Privacy Statement and the Terms and Conditions at any time without prior notice. You are advised to periodically review the Privacy Statement and the Terms and Condition. Your access to the website will be terminated upon your notice to BPS that any change is unacceptable, otherwise your continued use shall constitute your acceptance of all changes and they will be binding upon you.
In these Terms and Conditions, the following terms will have the respective meanings specified below unless the context otherwise requires:
“User” or “Client/Employer” means the person, job seekers or the company who comes to apply for BPS’s services, including members and non-members
“Advertisement” means the advertisement to find persons to be employed to work in any job, including the any forms of advertisement as shown on BPS website.
“Job Seeker” means the persons seeking employment.
“Member” means the one applies for membership with BPS and has been given the login and password
“Website” means any website or job portal owned and operated by BPS
2. Acceptable Website Uses
a. Job Seeker
Job seeker agrees that he/she will only use the website for lawful purposes and seeking employment.
Job seeker agrees to keep his/her login name and password with care and not to disclose them to any other person (if needed). Job seeker is solely responsible for maintaining the confidentiality, safekeeping and security of such login name and password and shall notify BPS immediately of any unauthorized use of the same.
Job seeker confirm and acknowledge that he/she discloses data of his/her own volition when he/she applies for available job vacancies posted on or through the website for purposes of submitting, uploading or posting his/her resume on the website. By submitting, uploading, or posting his/her resume on the website, job seeker authorizes BPS to store his/her resume and information or data related thereto in the database of BPS.
Alternatively, job seeker may send his/her resume and the related information or data to BPS through the website in reply to any job advertisement. In such event, job seeker’s resume and the related information or data will remain active on the website and be stored in the Database at his/her own risk unless and until he/she chooses to delete them.
Job seeker also reserves the right to reject, disapprove or edit any part of the job seeker’s resume and information or data related thereto as it sees appropriate and to erase any personal data which BPS reasonably believes that such information or data are inaccurate, false, illegal, unlawful, infringe copyright/ trademark/ trade name/ trade secret or infringe any other intellectual property rights or invade the privacy of the other having regard to the purpose for which the data are or are to be used.
BPS will not release job seeker’s personal data to any employer without his//her permission unless required by any authorized institution or obliged under the prevailing laws and regulations. Job seeker acknowledges and agree that BPS will, if he/she authorizes, release his/her resume (without his/her personal and contact information and name of his/her current employer) to employer through the use of BPS’s search engine or any other means for the sole purpose of enabling employer to recruit and assess the suitability of job seekers in relation to any vacancy. Job seeker agrees that BPS may use his/her personal data (without his/her name, address and other personal identifiable information) for marketing purposed which may be directed to either potential employers, their respective agents or anyone under their employ.
Although BPS shall use its reasonable endeavors to restrict access to the database to personnel of BPS, it does not guarantee that other parties will not, without BPS consent, gain access to the database. Job seeker acknowledges that the employers and other parties who have otherwise gained access to the database may have retained a copy of job seeker’s resume. BPS is not responsible for the retention, use or privacy of resumes in these instances, or for the use or privacy of resumes by any of such parties while the resumes are in the database.
BPS will not be responsible or held liable in any way if other users, in breach of the Terms and Conditions, use the job seeker’s personal data, information, or materials for any purpose rather than for recruiting potential employees. Job seeker accepts that all personal data, information, or materials given to employers or other users, or submitted on or through the website, are given entirely at his/her own risk.
b. Clients (Employers)
BPS reserves the right to change the service fee or institute new charges or fees, from time to time, as it deems appropriate. In the event that any client fails to pay the service fee or any other fees or charges to BPS, BPS reserves right to suspend or terminate the client’s web page and/or advertisement and/or right to access the database, without prejudice to all other rights and remedies available to BPS.
c. Prohibited Uses
i. Job seeker will not post any non-resume related information or data and/or incomplete, false or inaccurate resume related information or data on the website.
ii. All users will not use the website in any manner that infringes the intellectual property rights or proprietary rights of others.
iii. All users will not print, download, duplicate, transmit or otherwise copy, reproduce, re-distribute, republish or use any personally identifiable information about other users save and except that the employers may use the database and/or job seekers’ resumes and the information or data related to lawful purposes and promoting any job related activities. All unsolicited communications of any type to users are strictly prohibited.
iv. All users are prohibited from violating or attempting to violate the security of the website including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertisements for products or services. Violations of system or network security may result in civil and/or criminal liabilities.
v. All users will not upload, post, publish, transmit, distribute, circulate or store any material in whatsoever way relating the website (i) in violation of any applicable laws or regulations; (ii) in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights or proprietary rights of others or violate the privacy or publicity or other personal rights of others; (iii) that is harmful, defamatory, libelous, obscene, discriminatory, harassing, threatening, abusive, hateful, racist, blasphemous, false, illegal, improper or is otherwise offensive or objectionable; (iv) in the manner that causes unrest in politics, religion, national security or stability of BPS; or (v) that contains viruses, trojan horses, worms, corrupted files or other materials or programs that may interrupt, damage, or limit the functionally and operation of the website, the services, or of any computer software or hardware or telecommunication equipment.
vi. All users are prohibited in using screen scraping, data mining, robot or similar data gathering and extraction tools on the website for setting, maintaining, advancing or reproducing information contained on our website on your own website or in any other publication, except with our prior written consent.
BPS reserves the right to prohibit reproduction and distribution, or any other acts that may alter the information within, of parts of the website/document/presentation or of the document/presentation in its entirety without the prior written consent of BPS.
BPS reserves the right to monitor the website; however, BPS takes no responsibility whatsoever for any material on the website not posted by BPS or posted by BPS on behalf of users. All users acknowledge and agree that they are entirely responsible for the form, content and accuracy of any resume, information, data, advertisement, web page and/or material submitted by them to BPS posting on the website. BPS does not warrant all items mentioned above will be viewed by any specific users or generate an attainment of recruitment.
BPS will not warrant that the website will operate error-free from various harmful mechanisms and/or technic. BPS will not be responsible for those costs and any loss or damage of whatever occurrence. Users should independently appraise and verify the accuracy, entireness, and reliability of the information on the website and seek professional advice where necessary.
BPS reserves the right to remove any users at any time for violating the Terms and Conditions and the laws and regulations and also reserves the right to remove any abusive, unlawful, or inappropriate material without notice and/or consent.
The website may contain links to third-party website. BPS is not able to control over or rights in such third-party website and is not responsible for their availability or security. Moreover; any data or materials posted on the website by any user may be viewed by users of other websites linked to the website of BPS and BPS will not be responsible for any improper use by any user or third-party.
6. Membership Termination
All users acknowledge and agree that BPS has the right to terminate the password of member for the service using (if applicable) and to erase all information posted on the advertisement on the website, whatever the reason, including but not limited to the failure to use the service, causing to believe that you have violated the conditions of service providing and BPS will erase to provide all or part of the service, whether the notice is given, including the deletion of relating information and files during the time you were the member or obstruct your access to the files or such service and you agree that BPS will not be liable for damages from the termination, cancellation, or deletion.
The provisions of the Terms and Conditions will be enforceable independently of each other and the validity of each provision will not be affected if any of others is invalid. In the event that any provision or any part of a provision of the Terms and Conditions is determined to be or become illegal, invalid, or unenforceable, the validity and enforceability of the remaining provisions or remaining part of the provision of the Terms and Conditions will not be affected and, in lieu of such illegal, invalid, or unenforceable provision or part of provision, there will be added as part of the Terms and Conditions one or more provisions as similar in terms as may be legal, valid and enforceable under the applicable law.
8. Right to delete
In certain circumstances users have the right to request that your personal information is deleted. You can make such a request at any time and BPS will evaluate if your request should be granted, however this right is subject to any legal rights or obligations where BPS need to retain data. For situations where in accordance with the law, BPS determine that your request to have your personal information deleted must be granted, BPS will do so without undue delay. Please bear in mind, once your data is deleted – that the Company might not be of service to you anymore once this data about you has been deleted. If you want to re-register with the company again, you will need to re-enter your data.
